7. Joint Sully Land Use and Transportation Committee topics:
   
   • In light of an amendment to the Code of Virginia, the county has provided us with a statement be to read when our land use committee meets with a prospective applicant for a rezoning or proffer condition amendment (PCA) for new residential development and/or new residential use in areas of the County that are not exempt from Virginia Code Section 15.2-2303.4. It is recommended that if our committee is meeting with more than one applicant to read this statement for each rezoning/PCA.
   • All times estimates are provided as a courtesy, presentations will start after the completion of the proceeding presentation, however long it takes. Recommend that presenters be ready at least 30 minutes prior to their scheduled time.
   • Prospective presenters are requested to register on the Land Use and Transportation Committee Presentation Registration Form as a condition of their presentation.

   1. 7:00 — A PCA to allow data centers versus currently approved office buildings
      • This a return presentation since their presentation in June 2021
      • From the Joint Sully District Land Use and Transportation Committee Presentation Request Application Form:

        • Proposal: A PCA application to amend the currently approved plan which shows two office buildings to allow another option of two data centers. Our Planning Commission date is Sept. 29.
        • Location: Corner of Parkstone Drive and Conference Center Drive in Westfields. 43-4((6))37A and 27

      • The following items have changed since their June presentation.
        • They have revised their plan for the Parkstone property data centers.
        • Although nothing has changed in terms of the buildings, they did receive late notice from NOVEC that the only way to service the data centers was through boxes in a corner of the buffer area to Braddock Road. They have limited the area as much as possible and a hefty buffer still remains. The area will contain approximately 8 boxes that are about 4 feet tall as shown on the attached picture. It is not a substation or anything large such as that.
        • As was requested, they have confirmed that they are maintaining the trail connection from the existing trail on Braddock to the property.
   2. 7:30 — Westfields 4700 Centreville PCA/RZ to extend the Westone Plaza Shopping Center with the development of a one-story commercial building
   • From the Joint Sully District Land Use and Transportation Committee Presentation Request Application Form:
     • Proponent: Bernard S. Suchicital (agent), Walsh, Colucci, Lubeley & Walsh, P.C.
     • Proposal: A RZ 2021-SU-013 and PCA 2003-SU-040-02 application to extend the Westone Plaza Shopping Center with the development of a one-story commercial building on approximately 0.93 acre of land area. The request involves rezoning the site area from C-6, I-3, and R-1 to the C-6 District. While the Applicant proposes flexibility to address market demand, the contemplated use of the building is a veterinary hospital within 3,200 square feet of gross floor area.
     • Location: At the northwest quadrant of the intersection of Sully Road and the Poplar Tree Road extension. Site access will be via the Westone Plaza Shopping Center.

   • Earlier this year, 4700 Centreville LLC (the "Applicant") submitted a PCA/RZ application to extend the Westone Plaza Shopping Center. They are still relatively early in the review process, with a scheduled Planning Commission public hearing on March 9, 2022. However, they wanted to reach out to see if there might be some availability in either the Sully District County Land Use and Transportation Committee's November or December agenda so they might present this as an informational item?

   • Board of Supervisors Adopts Redistricting Plan for New Local Election Districts
   
   • The Board adopted new local election districts during the meeting as a result of its redistricting efforts. The process began this past February and was led by the Redistricting Advisory Committee. The public was invited to submit potential redistricting plans in September and a public hearing took place on November 9.
   • The adopted redistricting plan was submitted by a member of the public, and maintains nine election districts for the Board of Supervisors and School Board. However, it shifts seven precincts into different districts, moving them in whole or in part:
   • 626 - Saratoga (from Mount Vernon to Springfield)
   • 703 - Fort Buffalo (from Providence to Mason)
   • 717 - Woodburn (split between Providence and Mason)
   • 730 - Penderbrook (from Providence to Springfield)
   • 827 - Irving (from Springfield to Braddock)
   • 840 - West Springfield (from Springfield to Lee)
   • 933 - Compton (from Sully to Springfield)
   • While these new districts take effect immediately, they are subject to certification by the Virginia Attorney General in accordance with the Virginia Rights of Voters Act of 2021. This process could take up to 60 days. Members of the Board of Supervisors and School Board who are in office now will complete their terms, representing the new districts as constituted in the ordinance adopted today.
   • State law requires that Fairfax County's Board of Supervisors be composed of one chairman elected at-large and one district supervisor elected from each local election district. The County may have as few as five districts or as many as 11 under state law.
   • Although not legally tied to the redistricting process, the Board of Supervisors will now consider new names for the districts. The Redistricting Advisory Committee will take on this task with a focus on racial and social equity. The group will have until March 1 to come up with its recommendations. The currently existing district names will remain in place, however, until the board decides whether it will make any changes.
   • Board of Supervisors Expands Real Estate Tax Relief Program
   • The Board approved an expansion of the real estate tax relief program for seniors and people with disabilities. This program serves citizens who are either 65 or older or permanently disabled, and meet the income and asset eligibility requirements. 
   • Under the program's newly expanded qualifications, the maximum income and net worth limits to qualify for tax relief were raised, and these changes will take effect on January 1, 2022. The maximum gross income to qualify for tax relief has been raised to $90,000 from the previous $72,000 limit. Similarly, the limit on net worth increased from $340,000 limit to $400,000. Additionally, the expanded program lets homeowners exclude up to five acres of land that cannot be subdivided from the net worth calculation for homes.
   • In addition to the higher income and net worth limits, the program adds a new 75% relief bracket, a cap on the total taxes relieved and an option to defer tax payments. These changes would take effect on Jan. 1, 2023. The new 75% relief bracket will be available to households with a total combined income between $60,001 to $70,000, and the amount of tax relief for all tax relief brackets would be capped at 125% of the mean assessed value of Fairfax County homes. Residents will have the option to defer paying real estate taxes, subject to interest. To qualify, households may have up to a total combined income of $100,000 and net worth of $500,000. Any deferred taxes would be subject to interest at the Wall Street Journal prime rate, plus 1% per year, subject to a maximum rate of 8% per year.
   • In addition to the real estate tax relief program for seniors and those with disabilities, Fairfax County currently provides real estate tax exemptions for:
     • Disabled veterans and their surviving spouses
     • Surviving spouses of a member of the armed forces killed in action
     • Surviving spouses of a first responder killed in the line of duty

10. Scheduled Meetings/Events
    • Compton Road Shared-Use Path - Virtual Public Information Meeting
    • The Virginia Department of Transportation (VDOT) held a virtual public information meeting on Thursday, December 9 at 7 p.m. in order to discuss plans to build a shared-use path along Compton Road (Route 658). This project aims to improve bicyclist and pedestrian safety, accessibility and connectivity to the Cub Run Trail system. 
    • Although the meeting has concluded, comments will continue to be accepted until December 20, 2021 via the following methods:

    • Learn about Agency Projects at the Northern Virginia Joint Transportation Meeting
    • The public was invited to a joint virtual meeting on Wednesday, December 15 at with representatives from various state-level transportation agencies. Per Virginia code §33.2-214.3, these organizations shall conduct a joint public meeting annually for the purposes of presenting to the public, and receiving comments on, transportation projects proposed and conducted by each entity in Planning District 8 (Northern Virginia).
    • The meeting included an opportunity to receive public comments following agency presentations on transportation initiatives. The meeting will be held virtually and attendees must register online. The team of VDOT, DRPT, OIPI, NVTA, NVTC and VRE representatives made presentations highlighting their transportation programs, regional collaboration and received public comments about Virginia's transportation network.
